The owner and manager of an upmarket UK restaurant looked to Employment Practice and Law for specialist advice on disciplinary and grievance procedures in the workplace.

The Head Chef of the client’s establishment had been offensive to customers and staff members to the point that the client said that there was no question that the Head Chef should be let go.  The client required expert advice and guidance on the correct procedures and actions to achieve this outcome. A complicating factor to the case was the Head Chef concerned had behaved in the same way previously during his employment, and no formal action had been taken.

The client was asked to call the employee to a disciplinary hearing to discuss their actions viewed as potential gross misconduct, which could have resulted in dismissal. The outcome was that the employee resigned with immediate effect rather than risk being dismissed.
